Terms & Conditions (T&C)

1. Scope

(1) These Terms and Conditions ("T&C") apply to all orders placed by you as a consumer* via our online shop at funcmatcha.com.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

(3) Deviating terms and conditions of the customer shall not apply unless we expressly agree to their validity in writing.

*If you order as a business customer, these T&C apply accordingly unless otherwise agreed.

3. Conclusion of Contract

(1) The presentation of our products in the shop does not constitute a binding offer but an invitation to place an order.

(2) By submitting an order via the “Checkout” button, you make a binding purchase offer.

(3) The automatically generated order confirmation only documents receipt of your order and does not constitute acceptance.

(4) The contract is concluded only when we explicitly confirm your order by email or when the goods are dispatched to you.

(5) Please carefully review your information before submitting your order.

4. Prices, Shipping Costs & Payment Methods

(1) All prices displayed on the website include the statutory VAT.

(2) Additional shipping costs may apply; these will be shown during the checkout process.

(3) Available payment methods are those displayed at checkout. We may exclude individual payment methods in specific cases.

(4) The purchase price becomes due upon conclusion of the contract.

5. Delivery, Shipping & Transfer of Risk

(1) We deliver within the delivery areas indicated in the shop.

(2) Stated delivery times are approximate.

(3) For consumers:
The risk of accidental loss or deterioration of goods passes to you only upon delivery.

(4) For business customers:
The risk passes to the carrier once the goods are handed over.

(5) If we are permanently unable to deliver a product, we are entitled to withdraw from the contract. Any payments already made will be refunded immediately.

6. Retention of Title

The goods remain our property until fully paid.

7. Right of Withdrawal

(1) As a consumer, you have a statutory right of withdrawal.

(2) Withdrawal conditions can be found in our Cancellation Policy, which forms part of these T&C.

(3) Please note the exclusion of the withdrawal right for sealed food products once the seal has been removed (e.g. opened matcha packaging).

8. Return Costs in Case of Withdrawal

You bear the direct costs of returning the goods, as outlined in the Cancellation Policy.

9. Statutory Warranty (Defect Liability)

(1) Statutory warranty rights apply.

(2) The limitation period for warranty claims is 2 years from delivery.

(3) In case of obvious transport damage, please report it to the delivery service if possible and inform us as well. Your statutory rights remain unaffected.

10. Guarantees

If product guarantees are offered, the respective terms are outlined in the specific guarantee declaration.
Statutory warranty rights remain unaffected.

11. Health & Product Information

(1) Our products are food items. Please follow all instructions regarding ingredients, allergens, storage, and use.

(2) Any information regarding effects or well-being is general guidance and does not replace medical advice.

(3) If you are pregnant, breastfeeding, have pre-existing conditions, or take medication, we recommend consulting a medical professional before consumption.

12. Liability

(1) We are fully liable for damages arising from:

  • intent and gross negligence,

  • injury to life, body, or health,

  • the Product Liability Act,

  • assumed guarantees.

(2) In cases of slight negligence, we are liable only for breaches of essential contractual obligations and limited to foreseeable, typical damages.

(3) Otherwise, liability is excluded.

(4) These limitations apply also to our legal representatives and agents.

13. Use of the Website & Intellectual Property

(1) Content such as text, images, graphics, and designs on funcmatcha.com is protected.

(2) Use is permitted only for private purposes. Any further use requires our written consent.

14. Shopify as Technical Platform

Our shop is technically operated by Shopify.
The purchase contract is solely between you and KUPE UG (Func Matcha).
Shopify is not a contracting party to your order.

15. Data Protection

Information on the processing of personal data can be found in our Privacy Policy available on our website.

16. Online Dispute Resolution / Consumer Arbitration

(1) The EU Commission provides an Online Dispute Resolution platform:

(2) We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

17. Applicable Law & Jurisdiction

(1) The laws of the Federal Republic of Germany apply; the UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

(2) For consumers residing in an EU member state, the mandatory consumer protection laws of their country of residence also apply.

(3) For business customers, the exclusive place of jurisdiction is the registered seat of KUPE UG (Berlin).

18. Amendments to the T&C

We may amend these T&C for valid reasons with effect for the future.
The current version is always available on our website.

19. Final Provisions & Contract Language

(1) Should individual provisions be invalid, the remaining provisions shall remain valid. Statutory law shall apply in place of the invalid provisions.

(2) Contract Language / Language Versions:
Our shop is available in German and English.
The contract, order, and business languages are German and English.
In case of discrepancies, the German version shall prevail.
